The Tata/ Thyssenkrupp prohibition and merger enforcement in basic industries

Antitrustitalia’s 52 lunch talk is scheduled on Thursday, 11 July 2019, 12:30 pm at the European Commission’s Directorate General for Competition (DG COMP)’s Auditorium in Brussels (Place Madou 1 │ 1210 Saint-Josse-ten-Nood │ Metro Madou).

Daniele Calisti, Deputy Head of Unit E.4 (mergers) in DG COMP of the European Commission, will give a presentation in English on:

‘The Tata/ Thyssenkrupp prohibition and merger enforcement in basic industries’

The very recent prohibition of the Tata Steel / Thyssenkrupp JV was the last of a number of cases in European basic industries where the Commission intervened. These mergers raised diverse issues, such as share computation, value chain integration, imports and trade measures, as well as how to design a workable structural remedy. Daniele will discuss the recent prohibition and lessons learnt from those other recent merger cases.

Daniele Calisti is Deputy Head of DG Competition’s Unit responsible for mergers in basic industries, manufacturing and agriculture, where he lead investigations into several prominent recent cases. He previously worked on the drafting and negotiation of the 2014 antitrust damages directive. He holds an LLM from King’s college London and a PhD in Public Law and Economics from La Sapienza University of Rome.

Lunch will be provided at 12:30, the presentation will begin at 13:00 and will close at 14:30. Important note: Please allow time to register at the Madou Tower desk, we recommend coming at noon.

Antitrustitalia’s 24th Antitrust Lunch is scheduled on Friday 24 April 2015 at Confindustria Bruxelles (Av. de la Joyeuse Entrée 1 – 1040 Bruxelles – Metro Schuman).

Sophie Moonen, Head of Unit C5 – DG COMP, will give a presentation in English on:

“The Commission’s assessment of mobile telecom mergers: what have we learned?”

Recent years have seen a wave of consolidation in the mobile telecom industry across Europe, and further consolidation is on the horizon with rumours of possible mergers in many countries, including France, UK, Spain and Italy. The European Commission has reviewed a number of mobile mergers over the past few years and others may come under the Commission’s scrutiny soon. Sophie will talk us through the Commission’s recent experience in assessing mobile mergers in Austria, Ireland and Germany, focusing on the key aspects of these cases and discussing some general lessons.

Sophie Moonen is Head of Unit C5, DG COMP – European Commission, responsible for mergers in the IT, telecoms, and media sectors. Since joining DG COMP in June 2002, Sophie has dealt with mergers in numerous sectors, including IT, telecoms, media, transport, energy, pharmaceuticals and mining. Examples of the cases that she worked on include: Oracle/Sun Microsystems, Western Digital/Viviti Technologies, Universal/EMI, and Hutchison 3G UK/Telefónica Ireland. Prior to joining the Commission, Sophie spent several years in private practice working at Wilmer, Cutler and Pickering (Brussels and Washington, D.C. offices). She graduated at the University of Liège and holds an LL.M. from the University of Michigan. Sophie has been a member of the NY bar since 1999.
